General purchasing conditions

COVID-19

Orders come out from our warehouses every day, but due to the Covid-19, the management and transport of the luminaires can be delayed.

Once the luminaires are in preparation, no returns will be allowed.

Please be patient, we work every day to be able to give you the best possible service.

 

Free Shipping

Free transport for orders over:

  • 180,00 € Spain mainland, except Canary Islands, Balearic Islands, Ceuta, Melilla and Andorra, being in these cases the shipping cost to be paid by the customer, indicating once the order is placed and with the possibility of cancellation of the same (net amount).
  • 15€ of postage on invoice in case of orders under 180€.
  • 1000,00€ European Union, including England, Canary Islands, Ceuta, Melilla and Andorra (net amount).
  • Orders under 1000,00€ for shipments to the European Union will be charged to the customer.
  • Shipments to other countries outside the European Union (including exceptions indicated), will be charged to the customer, indicating the amount of the shipment once the order has been placed and with the possibility of cancellation.
  • All bulky or palletised goods will be delivered at street level for logistical reasons. In the event that delivery to the customer's home is required, this delivery will incur additional costs.

Ilutop cannot be held responsible for the consequences of the delay or loss of the product by the transport company.

Product availability

All product orders are subject to availability.

The delivery times shown for our products are for guidance only.

In this regard, if there are difficulties in the supply of products or if items are out of stock, we reserve the right to provide you with information about substitute products of equal or superior quality and value which you may order.

If you do not wish to order such substitute products, we will refund any amount you may have paid.

Price and payment

The price of each product will be the price stated on our website at any given time, except in the case of obvious error.

Whilst we try to ensure that all prices shown on the website are correct, errors may occur.

If we discover an error in the price of any of the products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.

If we are unable to contact you, the order will be deemed cancelled and any monies paid will be refunded in full.

We shall not be obliged to supply you with any goods at the incorrect lower price (even if we have sent you confirmation of dispatch), if the pricing error is obvious and unmistakable and could reasonably have been recognised by you as the incorrect price.

Ilutop is not responsible for price changes affecting products and/or orders.

For operational reasons tariffs are not always up to date and Ilutop reserves the right to cancel an order placed at a price corresponding to a tariff that is not in force.

Returns

The products offered on ilutop.com are manufactured exclusively, individually, for our customers so that in certain products will not accept returns of any kind, unless otherwise stated by the supplier of ilutop.com.

According to Article 103 of the Law of Consumers and Users, if once the order is placed online, the customer decides to withdraw (return the product) and terminate the contract, you may do so freely within 14 working days from receipt of the product, being sufficient to send an e-mail to the following email address: info@ilutop.com.

In order to return the goods for withdrawal, the goods must be in perfect condition, with all its accessories complete and with the original packaging intact. The customer may return the goods personally or through a transport company. The transport costs incurred by the exchange shall be borne by the purchaser. In the event that the consumer chooses to return the goods via a transport company, he/she must take all necessary measures to ensure that the original manufacturer's packaging is not damaged, altered or deteriorated in any way. ILUTOP reserves the right to carry out a preliminary analysis of the goods before accepting the return. ILUTOP will examine the contents in order to verify that they are in perfect condition for acceptance. Receipt of the returned goods will in no case imply acceptance or conformity of their condition, and ILUTOP will have a period of 15 days to inform the customer of any damage to the returned product resulting from unreasonable use, for which compensation must be paid by the customer. The refund of the price to the customer will be made by the method of payment selected by the customer.

If for reasons beyond our control we are forced to store the products purchased by the customer, storage costs will be applied.

If the manufacturer decides to charge Ilutop any kind of depreciation (handling costs, administrative costs, etc.) this will be charged to the customer.

Initial shipping costs will not be refunded.

Returns due to poor condition of the products or supply error, must be communicated within a maximum period of 24 hours from receipt to e-mail info@ilutop.com. In this case all costs will be borne by Ilutop.

Order confirmation

Your order will be confirmed and processed after the sending of a personalised e-mail as a notification, once the payment of your order has been verified, depending on the payment method you have chosen.

Any order is subject to management, modification or partial or complete cancellation before being confirmed.

Product warranties

Ilutop guarantees all the products it distributes in accordance with the laws in force and the following conditions.

To claim for lack of conformity of the product, the consumer can contact both the seller and the manufacturer of the product.

The law establishes a general period of 2 years from the date of purchase for the problem to become apparent.

If the defect comes to light during the first 6 months after the delivery of the good, it is presumed that the anomaly already existed at the time of purchase and the consumer does not have to prove anything.

However, when the lack of conformity becomes apparent after 6 months and in doubtful cases, the manufacturer may require an independent expert report in order to process the warranty.

In obvious cases of malfunctioning or irregular operation during the warranty period there is no problem at all.

In any case, during the time the consumer is deprived of the product, the warranty period is suspended, e.g. if the repair of an object takes 15 days, the warranty period will end 15 days later than originally foreseen.

Any manufacturer that has a warranty longer than the 2 years that marks the current law, must be processed directly with the manufacturer not being responsible for such cases Ilutop.

The shipping costs generated by the processing of the product warranty will be borne by Ilutop in those cases where it is assumed that the lack of conformity exists in the purchased good.

It will always be under the instructions given by Ilutop, upon request and acceptance.

In case of malfunction of the product in warranty period, the necessary shipping of the product to the manufacturer will be borne by the customer in any case.

NOTE: when the customer invoices on behalf of a company (non-individual), shipping costs to our facilities will always be borne by the customer, since the law on consumer goods does not regulate the sale between companies.

Receipt of products

If you notice when you receive the package that it is broken or has visible damage, you have to reflect the damage on the delivery note. To do this, you have to write ‘with damage’ next to your signature. This makes it possible for us to make a claim against the delivery agency. If we receive material in poor condition and do not report it, we will not be responsible for the damage.

Our right to modify these terms and conditions

We have the right to revise and amend these terms and conditions at any time.

You will be bound by the policies and conditions in effect at the time you use this website or place each order, unless we are required by law or governmental action to make retroactive changes to such policies, conditions or privacy policy, in which case any such changes will also affect orders you have previously placed.

For the resolution of any controversy that may arise with respect to their validity, execution, fulfilment or resolution (total or partial), they are subject to the jurisdiction of the Courts of JAÉN. This contract constitutes the complete and integral expression of the agreement between Ilutop and the user. The use of the Portal attributes the condition of user and implies full and unreserved acceptance of each and every one of the provisions included in this Legal Notice.
